Terms of Service

1. Definitions

"Service" means the Snapshot Listing Reports web application operated by Heizmann Technologies Inc. ("we", "us", "our") together with the optional Browser Extension. "Agent" or "you" means any registered user. "Report" means a seller traffic report generated through the Service. "Share Link" means a time-limited URL allowing public access to a Report (Pro plan only). "Cover Page" means an optional branded title page prepended to a Report PDF (Pro plan only). "AI Features" means metric extraction, showing parsing, and narrative generation powered by artificial intelligence. "Content" means all data, images, and text you upload or create through the Service. "Browser Extension" means the optional Snapshot Listing Reports — Capture Extension for Chrome and Firefox, which lets you upload screen captures directly into your account; the Browser Extension is part of the Service.

2. Eligibility & Account Registration

The Service is intended for licensed real estate agents and brokerages in Canada (excluding Quebec — see Section 23). By creating an account you represent that you: (a) hold a valid real estate licence issued by a Canadian provincial regulator; (b) are at least 18 years of age; (c) will provide accurate, current information at registration and keep it current; and (d) are responsible for maintaining the confidentiality of your account credentials. One account per person. You must notify us immediately of any unauthorized access.

3. Subscription Terms

We offer two subscription tiers, both priced in Canadian dollars (CAD). All listed prices are exclusive of applicable taxes; GST/HST and any applicable provincial sales tax (PST) are calculated based on your province of residence and added at checkout by Stripe Tax:

• Standard: CA$29.99/month or CA$25.49/month billed annually (CA$305.88/year) — up to 6 active listings, 6 platforms per listing, unlimited reports, all 10 PDF templates
• Pro: CA$59.99/month or CA$50.99/month billed annually (CA$611.88/year) — up to 20 active listings, 10 platforms per listing, unlimited reports, all 10 PDF templates, report cover pages, seller share links, priority support

New subscribers receive a 30-day free trial (no credit card required) with a 3-day grace period (33 total days before access restriction). During the trial you receive full Pro-level access.

4. Auto-Renewal & Billing

Your subscription automatically renews at the end of each billing period (monthly or annual) at the then-current price unless you cancel before the renewal date. All payments are processed by Stripe in CAD. We do not store credit card numbers — all card handling occurs through Stripe's PCI-compliant systems.

If a payment fails, your subscription enters a grace period, then past-due status, and may be cancelled if payment is not resolved. We may change pricing with 30 days' notice; existing subscribers are grandfathered until their next renewal.

5. 30-Day Money-Back Guarantee

New subscribers are eligible for a full refund within 30 calendar days of their first subscription payment. To request a refund, email support@snapshotlistingreports.ca within the 30-day window. Refunds are processed within 10 business days to the original payment method. This guarantee applies to the first billing cycle only and does not apply to subsequent renewal payments.

6. Cancellation

You may cancel your subscription at any time through the Stripe customer portal (accessible from your account settings) or by contacting us. Upon cancellation, you retain access until the end of your current paid billing period. No partial refunds are issued for unused time beyond the 30-day guarantee window.

7. Promotional Codes

We may issue single-use promotional codes granting complimentary service periods (monthly, yearly, or lifetime). Promo codes are non-transferable, have no cash value, and may not be combined with other offers. Redeemed codes extend your current billing period or activate an inactive subscription. We reserve the right to revoke or expire promo codes at any time.

8. Acceptable Use

You must not:

• Input fraudulent, fabricated, or intentionally misleading data
• Misrepresent AI-extracted metrics to clients as guaranteed-accurate data
• Share account credentials with third parties
• Attempt to reverse engineer, decompile, or extract source code
• Use the Service to build a competing product
• Circumvent usage limits, rate limits, or access controls
• Upload content that infringes third-party intellectual property rights
• Use the Service for any unlawful purpose

Browser Extension use: The Browser Extension is a screen-capture tool. When you use it to capture content from a third-party website (for example a real-estate listing platform, social network, or analytics dashboard), you are responsible for ensuring your use of that third-party site complies with the site's own terms of service and any applicable contractual or licence restrictions. The Browser Extension does not negotiate, modify, or override those third-party terms on your behalf. You agree not to use the Browser Extension to capture content you do not have authorization to view, to capture content in violation of any third-party site's terms, or to capture content for any unlawful purpose. Updates to the Browser Extension may be installed automatically by Chrome, Firefox, or other browser stores; by continuing to use the Browser Extension you accept any such update.

9. AI Features Disclaimer

The Service uses artificial intelligence (Anthropic's Claude API) to extract traffic metrics from screenshots you upload, parse showing notification data, and generate closing narrative text for reports.

• AI-extracted metrics are estimates only — not guaranteed to be accurate. The AI may misread numbers, miss data, or produce incorrect values.
• AI-generated narrative text is a draft provided for your convenience. You are responsible for reviewing, editing, and approving all AI-generated text before including it in client-facing reports.
• You are solely responsible for verifying all data — including AI-extracted data — before presenting it to clients. The Service is a tool; it does not replace professional judgment.

We do not warrant the accuracy, completeness, or reliability of any AI-generated output. You can avoid AI processing entirely by manually entering all data.

10. User Content & Data Ownership

You retain ownership of all Content you create or upload (listings, branding assets, reports, screenshots, and Browser Extension captures). You grant us a limited, non-exclusive licence to store, process, display, and transmit your Content solely to provide the Service. This licence terminates when you delete your Content or your account. Captures uploaded via the Browser Extension are treated as Content for the purposes of these Terms — the same ownership, retention, and deletion rules apply (see the Privacy Policy, Section 15, for retention specifics).

11. Seller & Third-Party Data Responsibility

You may input third-party personal information into the Service, including seller names, phone numbers, buyer agent details, and showing feedback. By doing so, you represent and warrant that:

• You have appropriate authorization from your seller client to input their personal information into a third-party platform;
• You will obtain any consent required under applicable privacy law (including PIPEDA and PIPA) from the individuals whose data you enter;
• You are responsible for informing your seller client that a third-party service is used to generate reports;
• You will use the Service only for lawful purposes consistent with your professional obligations.

You indemnify and hold harmless Heizmann Technologies Inc. against any claims, damages, or liabilities arising from your input of third-party personal information without proper authorization.

12. Data Processing

When you input seller or buyer agent personal information into the Service, you act as the data controller and we act as the data processor for that information. As your data processor:

• We process seller and buyer agent data only as instructed by you — to generate, display, and deliver reports;
• We do not use seller or buyer agent data for any purpose beyond providing the Service to you;
• We maintain appropriate security safeguards as described in our Privacy Policy;
• We do not sell, rent, or share seller or buyer agent data with third parties for their own purposes;
• Upon deletion of your account, all seller and buyer agent data is deleted as described in the Privacy Policy.

13. Share Links

Share links are available on the Pro plan only. Reports shared via share links are accessible to anyone who has the URL — no authentication is required. Share links expire 30 calendar days after creation. Shared reports expose property details, traffic data, showing information (including buyer agent names), your contact information, and a downloadable PDF. You are responsible for reviewing report content before sharing.

14. Referral Program

Registered agents may receive a unique referral code (when the referral program is active). When a referred user subscribes and completes their first payment, the referrer receives one free month of service applied as a Stripe account credit. A maximum of 12 referral credits may be earned per 12-month cycle, resetting on the anniversary of the referrer's account. Self-referral is prohibited. Referral rewards have no cash value and are not transferable. We reserve the right to modify, suspend, or terminate the referral program at any time with 30 days' notice.

15. Intellectual Property

The Service, including all software, designs, PDF templates, AI integrations, and documentation, is the intellectual property of Heizmann Technologies Inc. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your active subscription. Your Content remains your property. Nothing in these Terms transfers intellectual property ownership in either direction.

16. Limitation of Liability

Our total aggregate liability for any claim arising from your use of the Service is limited to the fees paid by you in the 12 months preceding the claim. We exclude liability for consequential, incidental, special, punitive, or indirect damages, including but not limited to: AI inaccuracy; third-party platform data changes; data loss beyond commercially reasonable backup measures; seller or buyer agent claims arising from data you inputted; or any decisions made by your clients based on report content. These limitations apply to the fullest extent permitted by applicable law.

17. Warranty Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranty. We make no warranty of accuracy for AI features — metrics, extracted data, and generated text may contain errors. We make no warranty of uninterrupted or error-free service, or that the Service will meet your specific requirements. To the fullest extent permitted by law, all implied warranties are disclaimed.

18. Indemnification

You agree to indemnify, defend, and hold harmless Heizmann Technologies Inc. against claims arising from: your use of the Service; your violation of these Terms; your input of third-party personal information; your reliance on AI-extracted metrics in client communications; your distribution of reports containing inaccurate information; and any claim by a third party related to Content you uploaded or created.

19. Termination

You may cancel your subscription at any time (see Section 6). We may suspend or terminate your account for Terms violations, fraud, illegal activity, or non-payment, with or without notice depending on severity. After termination you have 30 days to request export of your data; after this period, data may be deleted. Sections covering limitation of liability, indemnification, intellectual property, warranty disclaimer, governing law, and dispute resolution survive termination.

20. Modification of Terms

We may modify these Terms at any time. You will be notified of material changes at least 30 days before they take effect, via email to the address on file. Continued use of the Service after the effective date constitutes acceptance. If you do not agree with modified Terms, you may terminate your subscription before the effective date.

21. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, including the Personal Information Protection and Electronic Documents Act (PIPEDA), the BC Personal Information Protection Act (PIPA), and Canada's Anti-Spam Legislation (CASL). The courts of British Columbia have exclusive jurisdiction. Parties will first attempt to resolve disputes informally for 30 days. If unresolved, disputes may be submitted to mediation in Vancouver, British Columbia.

22. General Provisions

If any provision is held unenforceable, the remainder continues in effect. These Terms (together with the Privacy Policy) constitute the entire agreement. We may assign these Terms; you may not without written consent. Failure to enforce a provision does not waive the right to enforce it later.

23. Regional Availability

The Service is not currently available to residents or licensees in the Province of Quebec due to French-language and regulatory requirements that have not yet been implemented. Attempts to register from Quebec may be restricted. We intend to expand availability to Quebec in the future.
